EU Trade Marks – VF International Sagl succeeds in its action against the decision of the Fourth Board of Appeal of EUIPO – Case T-548/17

In a judgment rendered by the General Court, a trademark opposition decision of the Fourth Board of Appeal of the European Union Intellectual Property Office (“EUIPO”) was annulled. VF International Sagl succeeded in its first plea in law, i.e. its complaint against the Board of Appeal’s holding that there could be no finding of a likelihood of confusion due to no similarity between VF International Sagl’s earlier marks and Ken Virmani’s trade mark. The General Court found that the marks in question were in fact, visually and conceptually similar.
