In der Sitzung vergangene Woche mit Martin Schweiger wurde mein Verständnis für AI-gestütztes Patent Drafting deutlich erweitert.

Martin hat ein systematisches Herangehen bei seiner Empfehlung für einen geeigneten Draft Robot anhand verschiedener Kriterien und einer Erfindungsmeldung, die ich ihm gegeben habe. Wir nutzten dann die Erfindungsbeschreibung, um gemeinsam mit einem solchen Roboter zwei Entwürfe für Patentanmeldungen zu erstellen, jeweils einen auf Deutsch und einen auf Englisch.

Die Qualität der Ergebnisse hat mich überzeugt und entsprach meinen Erwartungen, was nicht überraschend ist, da ich bereits zweimal an Martins Workshops zum AI-unterstützten Patent Drafting teilgenommen habe. Diese Erfahrungen befähigen mich nun, solche Aufgaben eigenständig zu bewältigen.

Hatte heute einen AI-Drafting-Kurs bei Martin Schweiger. More than 10,000 patent attorneys working in patent law firms or in the patent departments of companies, as well as clients, were directly invited to take part in the survey. The sample was collected via research conducted by Statista on relevant company websites, in publications and from the EPI (the Institute of Professional Representatives Before the European Patent Office), the professional body representing European patent attorneys. The invitations were sent by email with a personalised link that could be used only once.

As a co-founder of a technology startup I had a rare opportunity to participate in a hearing with the Intellectual Property Office of Singapore (IPOS). At the time, we had received three office actions, in which the examiner rejected our patent application because of a perceived lack of inventive step. We had replied with extensive substantive arguments, to which the examiner replied with new clarity objections, still rejecting our patent application. After careful preparation by Martin and his team – we attended the hearing at IPOS together with him and his senior patent engineer Tan Chong Teck. Martin was extremely focused on clarifying the outstanding questions from examiner which allowed us to answer these with the support of documentation available. Martin clearly explained the situation to the Examiner, citing fact and reasoning. It was a rare moment for me to see Martin use the full width of his professional expertise to secure the patent for us.

Martin and I worked together in a large international patent litigation team, representing a Japanese defendant against a German plaintiff before the High Court in Singapore. Martin turned out to be a very versatile team player for patent matters. Not only did he play a material role with the patent (non-)infringement and patent invalidity of the Singapore patent proceedings, he also attacked the sister EP patent with 3rd-party observations in already ongoing opposition proceedings. The sister EP paten was eventually revoked, and this had thereby also put the plaintif´s SG patent in suit in question. Martin supported the litigation team tremendously in navigating our expert witness meetings. And it was Martin who helped highlight and tenaciously persevered a late amendment issue of the patent in suit, which ultimately tipped the balance towards the defendant. In patent litigation matters, you want to have Martin in your own team, and not as an adversary.

When we were notified by the Singapore customs that there is a border seizure of counterfeit goods that were knock-offs of the products of one of our clients, I have asked Martin to come in for supporting us in Singapore.

Using his huge local network in Singapore, Martin got a court order for detaining the seized counterfeit goods in no time. He then engaged in negotiations with the freight forwarding company and finally destroyed the seized goods in a local waste incineration plant. This was documented on the front page of the local newspaper, this was a great PR for our client!

As we only see now, following Martin’s recommendations to handle this case has saved our client a six-digits amount of money, and five (5) years in processing time.

Martin and his teams in Munich and Singapore took the East-Asia and Germany roles in a world-wide anti-counterfeiting team that my firm managed for a big MNC from Germany. One single sentence describes best how working with him is: “consider it done”.

I could personally see Martin acting in professional full force during oral proceedings before the Appeal Chamber of the European Patent Office (EPO). We have instructed him to attack a granted business method patent that stood against our own technology. It was like watching two wolves hunting down a fox who was desperately trying to defend itself against death. Shortly after we were notified by our client Megastar that the Singapore customs made a border seizure of counterfeit goods in one the containers that our client was shipping, Martin presented me a court order for detaining the seized counterfeit goods and suggested to amically negotiate a settlement between our clients.
